When you purchase goods from our web shop, these are the terms and conditions on which we agree to supply them to you. These terms and conditions tell you who we are, how we will provide products to you, how you and we may change or end the contract, what to do if there is a problem and other important information. If you think that there is a mistake in these terms and conditions or they require any changes, please contact us to discuss.

All payments are managed through a sub-processor, Stripe International. KSS will continue to process your order and send your goods out, with help from our volunteers.

Prior to placing an order, you must click Accept to indicate that you agree to use our website shopping platform in accordance with these terms and conditions and the underlying statements contained herein. Please ensure you have refreshed your browser on each visit to ensure you are accepting the most recent set of terms and conditions.

If you are not happy to accept these terms and conditions, please do not continue with your online order. Goods can also be purchased via paper form, should you require an order form please contact us and we will be happy to send one to you.

1. Who We Are

Air Ambulance Promotions Ltd (AAPL) is a wholly owned subsidiary of Air Ambulance Charity Kent Surrey Sussex. AAPL is a Private Limited Company registered in England and Wales, Registration Number 02674568.

2. Privacy

We take your privacy very seriously and will treat all of your personal information in accordance with all applicable data protection laws in England and Wales. We use, store and process information in accordance with our Privacy Policy and Cookie Policy. By using our website, you consent to such use, storage and processing.

3. Ordering Products

All orders that you place on this website will be subject to acceptance of these terms and conditions.

All orders for products are subject to availability and we reserve the right to refuse to supply to any individual or company.

Your submission of an order represents an offer to purchase the products indicated by you and is not binding on us until we have accepted your order. This means that if a product is shown on the website but becomes unavailable, is incorrectly priced, incorrectly described or if we are unable to arrange delivery to your country or region, we will have no legal obligation to sell you that product.

Shortly after we receive your order, we will send you an acknowledgement via email. This email is issued automatically via Shopify and does not mean that your order has been accepted.

Acceptance of your order and completion of the contract between you and us will occur at the point at which we dispatch the product to you. Any products on the same order which we have not dispatched to you do not form part of that contract.

If we cannot accept your order for any reason, we will contact you to explain why, and we will re-credit your credit or debit card with the full amount of any sums debited in respect of any part of the order we have not accepted.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

We do not file details of your order for you to subsequently access direct from this website, so please print out these Terms and the order acknowledgement for your own records.

4. Donations

When you proceed through the checkout process you will be asked if you would like to make a donation to the Air Ambulance Charity Kent Surrey Sussex (KSS) whilst making your purchase.

This is not mandatory and will not affect your purchase in any way. You may proceed through the checkout process without making any donation if you wish.

All donations received by AAPL during the checkout process will be paid to KSS and will go into the KSS general funds, to help us provide lifesaving critical care. Supporters will not be able to request for their donation to go towards a specific project.

5. Price and Payment

Prices of all goods on our website are inclusive of any VAT which may be payable by you. All prices displayed on the website are quoted in UK Pounds Sterling and there is a flat delivery fee of £3.

We reserve the right to change prices listed without giving prior notice. The price you pay is the price displayed on this website at the time we receive your order, except in instances in which an error has occurred in displaying the price. Whilst we make every effort to ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of product you have ordered, we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you, we will treat the order as cancelled. If you cancel and you have already paid for the products, you will receive a full refund.

We accept credit and debit cards for orders via this website and all payments are handled by Stripe Inc.

Your account will be charged for payment at the time that the order is placed.

6. Delivery and Availability

We make every effort to deliver products within the estimated timescales, however delays are occasionally inevitable. If you do not receive your goods within the time quoted, please contact us.

All deliveries will be made by Royal Mail at the address specified by you in the order. In order to reduce costs, all delivery is fulfilled through KSS, using our fantastic volunteer network.

7. Cancellations and Returns Orders may be cancelled, and products returned in accordance with our Delivery and Returns Policy.

8. Disclaimers and Limitations

We may make changes to the material on our website, or to the products and prices described in them, at any time without notice.

We shall take reasonable care to ensure that all orders, donations and subsequent transactions are conducted via a secure link. However, the security of information and payments transmitted via the Internet cannot be guaranteed and as we are not responsible for the operation of the secure link we will not, except where the AAPL have acted negligently, be liable for any loss you may suffer if a third party obtains unauthorised access to any information you provide.

We do not warrant that the functions contained in this website will be uninterrupted or error free, that defects will be corrected, or that this site or the server that makes it available are free of viruses or bugs or represent full functionality, accuracy or reliability of the materials. We will not be liable for any loss, disruption or damage to your data or your computer system or any other damages (including amongst other losses, loss of profit or loss of use) arising out of your use or delay or inability to use the site, its content or any link to another website arising in contract, tort (including negligence) or otherwise except in the case of death or personal injury caused by our negligence. Nothing in this disclaimer applies to any products which you purchase from the website.

We do not limit in any way our liability by law for fraud or death or personal injury caused by our negligence or breach of duty or any other liability which cannot be excluded or limited under applicable law.

We will not be liable for any loss or damage caused by us or our employees or agents in circumstances where: –

· Loss or damage was not reasonably foreseeable to both you and us when you commenced using the website or when a contract for the sale of products by us to you was formed.

· Loss or damage was not caused by any breach by us, our employees or agents; or

· Any consequential loss where the loss or damage relates to business and/or non-consumers (including but not limited to loss of profits, revenue, contracts, anticipated savings, data, goodwill or wasted expenditure).

Certain content, products and services available via our Service may include materials from third parties. We are not responsible for examining or evaluating the content or accuracy of third party links or emails and we do not warrant any third-party materials or websites, or any other materials, products, or services of third-parties.

10. Disclaimer of Warranties; Limitation of Liability

We do not guarantee, represent or warrant that your use of our Service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. You agree that from time to time we may remove the Service for indefinite periods of time or cancel the service at any time, without notice to you. You agree to indemnify, defend and hold harmless AAPL, KSS, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms & Conditions or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

12. Severance

If any of these Terms should be determined to be illegal, invalid or otherwise unenforceable by reason of the laws of country which apply to these Terms, then to the extent (within that jurisdiction) that the Term (in part or in whole) is illegal, invalid or unenforceable, it shall be severed and deleted from these Terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.

13. Waiver

If you breach these Terms and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these Terms. The failure of us to exercise or enforce any right or provision of these Terms & Conditions shall not constitute a waiver of such right or provision. These Terms & Conditions and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms & Conditions).

14. Events Beyond our Control

We will not be liable to you for any delay in delivering your order or breach of our obligations, if the delay or breach is due to acts of God, civil commotion, riots, strikes, malicious damage, floods, drought, fire, flood, legislation, failure of ISP or telecommunications provider or other cause beyond our reasonable control. This does not affect your statutory rights.

15. AAPL’s Rights

15.1. You agree that AAPL and/or KSS shall be entitled to directly enforce the provisions of these Terms, and to take the benefit of any rights or any limitation or exclusion of liability in these Terms.

16. Law, Courts and Language

These Terms, use of this online shop and the supply of products by us are governed by and shall be interpreted in accordance with English law. In the event of any dispute arising in relation to these Terms, use of this website or in relation to the supply of any products by us the English courts shall have exclusive jurisdiction over the dispute. These Terms and this website are provided in the English language only.
