Air Ambulance Promotions Limited Lottery Terms and Conditions

Governance
1. Air Ambulance Charity Kent Surrey Sussex (KSS) wholly owns a trading subsidiary, Air Ambulance Promotions Limited (AAPL) which promotes society lotteries to raise funds that helps support KSS’ purpose of saving lives and ensuring the best possible patient outcomes (the “Promoter”).
2. AAPL operates and promotes our society lotteries and is licensed and regulated in Great Britain by the Gambling Commission (gamblingcommission.gov.uk).
3. AAPL is a registered Company (No 2674568), registered office address Air Ambulance Building, Rochester City Airport, Maidstone Road, Chatham, Kent ME5 9SD. Responsible persons: Symon Russell, James Cook, David Mantz.
4. Your purchase of lottery entries is from AAPL as the promoter. By entering one of our lotteries, you agree to be bound by these terms and conditions, the Gambling Act 2005 and any relevant regulations made thereunder from time to time. Any participation instructions form part of these terms and conditions.
Our Draws
5. We operate three draws; the Regular Lottery, the Superdraw (jackpot draw) and the 24/7 Club Lottery.
6. The 24/7 Club Lottery and Superdraw are additional draws to the Regular Lottery and only available for entry to paying members of the Regular Lottery.
7. Each of the draws will take place every week on a Wednesday. If the draw cannot be performed on a Wednesday due to public holidays or unforeseen circumstances, then the draw will be performed on the next available working day.
8. Each draw is conducted using the Donorflex Lottery Random Number Generator (RNG) which is fully licensed and regulated by the Gambling Commission and has been independently tested, using a variety of industry-standard statistical tests to produce truly random numbers.
9. Winners will be announced within three working days on the KSS website (aakss.org.uk.uk/lotteryresults). The Superdraw is a jackpot rollover draw with a maximum prize value of ÂŁ25K, and the winners will be announced on the website as and when this occurs. The prize may not be claimed by a third party on your behalf.
10. A maximum of three consecutive draws may take place retrospectively at the discretion of the AAPL Board of Directors.
11. The maximum number of chances permitted for each of these draws, for any individual, is 10 per week per draw. When you sign up via one of our face-to-face fundraisers, the maximum number of chances permitted is two. Should you wish to increase this, please contact our registered office.
12. A society lottery is a fun way to donate money to a great cause with having the added bonus of the chance to win a cash prize. All proceeds, after the deduction of legal prizes and expenses, shall be donated to KSS. We want to ensure you feel empowered to make informed choices about joining our lotteries. 13. The prizes for the lotteries are printed on the promotional material provided and are advertised on the website. You cannot request an alternative to any prize and no interest is payable.
14. AAPL has the right to change the prize structure at any time in line with the Gambling Act 2005.
General
15. You must be over the age of 18 and acknowledge that we reserve the right to carry out age verification checks. Any person found to be under the age of 18 will be disqualified and forfeits any right to any prize.
16. You will not buy or purport to buy an entry to any draw on behalf of anyone under the age of 18 and understand that doing so is an offence.
17. You must be a resident of, and have a bank account in, England, Scotland or Wales. Unfortunately, residents from overseas, Northern Ireland, the Channel Islands and the Isle of Man are unable to enter.
18. Entry to the lottery is not open to employees or Trustees of KSS, or anyone else directly connected or responsible for running the draw.
19. All entrants are solely responsible for providing and (where necessary) updating AAPL with their accurate and up to date contact details and AAPL will be in no way liable for any failure or inability to contact any member due to any errors, omissions or inaccuracies in the contact details that the member has provided.
20. AAPL must either publish or make available information that indicates that a valid award took place. To comply with this obligation AAPL will send the surname and county of major prize winners and, if applicable copies of their winning entries, to anyone who emails or writes to (enclosing a self-addressed envelope) within one month after the closing date. If you object to any or all of your surname, county and winning entry being published or made available, please contact us. In such circumstances, the Promoter must still provide the information and winning entry to the Advertising Standards Authority on request.
21. If for any reason a technical interruption, fault or site failure occurs when purchasing online, AAPL does not take any responsibility for incomplete purchases and any incomplete purchases will not be considered valid for entry into a draw. AAPL accepts no responsibility for any purchases which are not complete for any reason.
22. Should AAPL be unable to pay a prize because we do not hold the correct details, and after thorough investigation which may include communication with the entrant’s last known bank, we will, after a period of six months, donate the prize back to KSS (although no Gift Aid will be claimed).
23. Subject to the above clause, prizes will be paid by cheque or BACS within 30 days of the draw date, unless there are additional verifications required. If a cheque remains uncashed for over six months, it shall be cancelled, and the unclaimed prize shall be donated to KSS (although no Gift Aid will be claimed).
24. Entrants should note the date and frequency of payments and ensure that funds are available to cover Direct Debit payments when due. AAPL will not be liable for any charges incurred unless as a result of our own negligence.
25. AAPL or any third-party agency providing canvassing services reserves the right to decline to accept any application.
26. AAPL also reserves the right to:
· cancel an existing subscription.
· award any prize to an alternative winner if AAPL has the grounds to believe that you have breached any of these terms and conditions, acted fraudulently or illegally, or on other reasonable grounds, and AAPL shall have no liability to you for any loss or damage you suffer arising from it exercising such rights.
27. AAPL may (without giving reason or notice at its absolute discretion) modify, terminate or suspend any and all of the lotteries in whole or in part.

Customer Funds
29. Only members who have paid a subscription to the relevant draw will be eligible to win.
30. Customer funds are player funds that AAPL holds on behalf of the players, other than the funds that have been allocated to a particular lottery.
31. Air Ambulance Promotions Limited holds customer funds in accounts separate from our business accounts. Funds are held in a mixture of current accounts and interest-bearing accounts. These funds are not protected in the event of insolvency as such customer funds are considered segregated but not protected. If we are notified that a paying lottery member is deceased, all monies present on lottery plays will be returned to the estate of the deceased.
Liability
32. No liability is accepted for:
a) Any loss or damage, including the right to receive a prize, suffered by you if you have not complied with these terms and conditions or any relevant participation instructions.
b) The loss, theft or delayed receipt of any communication or entry, or which is damaged or illegible, from which the entrant or winner cannot be identified, or which has insufficient postage (proof of posting is not proof of receipt).
c) Any late bank payments.
d) AAPL’s failure or inability to contact you and/or award any prize due to any error’s omissions or inaccuracies in the contact or bank details you have provided or your failure to update these if they change.
e) Loss or damage incurred by you in connection with your participation in the Lottery or your use of any prize (including but not limited to direct, indirect and/or consequential loss) or personal injury suffered in sustained in connection with the prize or any part of it.
f) Any interruptions or errors on or to the Website; technical hardware or software errors or failures or lost, faulty or unavailable network connections.
g) Any failure or delay beyond AAPL’s reasonable control.

Data Protection
AAPL will process your personal data in accordance with the Data Protection Act 2018, for the purposes of administering your subscription to play the Lottery.
Your personal data will be processed for the purposes of: Processing your payment, informing you of payment updates, administration of the Lottery, database management, undertaking quality control checks, conducting a welcome call to check your details are correct and transferring information to HM Revenue & Customs in respect of any possible Gift Aid claim.
We may contact you if we require further information to process your lottery payment or to administer your Player registration. Our privacy notice, available at www.aakss.org.uk/privacy, sets out how your personal data is used. If you want to change the communications you receive at any time, please contact us.
The Direct Debit Guarantee
This Guarantee is offered by all Banks and Building Societies that accept instructions to pay Direct Debits.
If there are any changes to the amount, date or frequency of your Direct Debit then we will notify you normally within 10 working days in advance of your account being debited or as otherwise agreed. If you request us to collect a payment, confirmation of the amount and date will be given to you at the time of the request.
If an error is made in the payment of your Direct Debit by us or your Bank or Building Society, you are entitled to a full and immediate refund of the amount paid from your Bank or Building Society. – If you receive a refund which you are not entitled to, you must pay it back when you are asked to.
You can cancel a Direct Debit at any time by simply contacting your Bank or Building Society. Written confirmation may be required. Please also notify us.
Law
These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
